TERMS OF SERVICE

These terms apply to your use of comfortcampervans.co.nz. Please read
them. By using this website you agree to them.
In these terms, "we", "us" and "our" mean Comfort Campervans, a business
operating in Auckland, New Zealand. "You" means the person using this
website.
1. THIS WEBSITE IS NOT A SHOP
You cannot buy a vehicle on this website. There is no checkout, no cart
and no online payment. We never ask for card details online.
This website exists to show you what we have, to answer your questions,
and to arrange a visit. Every vehicle is sold in person at our Auckland
yard, after you have inspected it and taken it for a test drive.
Nothing on this website is an offer to sell. A vehicle listing is an
invitation for you to contact us. A sale happens only when we and you
agree terms in person and we confirm it.
2. VEHICLE LISTINGS, PRICES AND AVAILABILITY
Every vehicle we list is a single, individual used vehicle. Once it is
sold, it is gone.
We update the website as quickly as we reasonably can, but a vehicle may
be sold, on hold, or under offer before the website shows it. We cannot
guarantee that a vehicle shown as available still is.
Prices are in New Zealand dollars and include GST at 15%. The price shown
is the price you pay for the vehicle. Every vehicle is handed over with a
new Warrant of Fitness, a current vehicle licence (registration) and a
fresh service already included, at no extra cost. We provide a GST tax
invoice with every sale.
Prices may change without notice. If a price, specification or other
detail is shown incorrectly because of a genuine error, we may correct
it, and we are not bound to sell at the incorrect price. If you have
already paid a deposit on a vehicle affected by such an error, we will
tell you promptly and refund the deposit in full if you decide not to
proceed.
3. VEHICLE INFORMATION AND SPECIFICATIONS
We take care to describe every vehicle accurately, including its year,
odometer reading, fuel type, transmission, self-containment status and
equipment. That information comes from the vehicle's documents and from
our own inspection.
Photographs are of the actual vehicle unless we say otherwise. Colours
can appear differently on different screens.
If a particular detail matters to your decision, ask us to confirm it
before you buy, and check it yourself when you inspect the vehicle. We
will confirm anything in writing if you ask.
Nothing in this section limits your rights under the Consumer Guarantees
Act 1993 or the Fair Trading Act 1986.
4. ENQUIRIES, VIEWINGS AND HOLDS
We aim to reply to phone calls, WhatsApp messages and emails the same
day, but we cannot guarantee a response time.
Viewings and test drives are by appointment. Bring your driver's licence
if you want to test drive. An overseas licence is fine, subject to New
Zealand road rules.
Booking a viewing does not reserve a vehicle. We may sell a vehicle to
another buyer at any time before you have paid a deposit or completed a
purchase.
Where you pay a deposit to hold a vehicle, the terms of that deposit are
set out in our Return and Refund Policy and confirmed to you in writing
before you pay.
5. OUR GUIDES AND ARTICLES
This website publishes guides about buying, owning and travelling in a
campervan in New Zealand, including WOF, registration, road user charges,
self-containment, freedom camping, driving on an overseas licence and
insurance.
These are general information only. They are not legal, financial,
mechanical or insurance advice. Rules change, and they can differ between
councils and regions. Always check the current position with the relevant
authority, such as NZTA Waka Kotahi, your local council, or the
Department of Conservation, before relying on it.
6. LINKS TO OTHER WEBSITES
This website links to third-party sites and services, including mapping,
messaging, inspection providers and government agencies. We do not
control them and we are not responsible for their content, availability
or their handling of your information.
7. USING THIS WEBSITE
You may use this website for your own personal, non-commercial purposes.
You must not use it in a way that breaks any law, damages or interferes
with it, attempts to gain unauthorised access to it, or scrapes, copies
or republishes its content in bulk.
All content on this website, including text, photographs, video and
layout, belongs to us or is used with permission. You may not reproduce
it commercially without our written consent. You may of course share
links to our pages.
8. YOUR INFORMATION
We handle personal information in accordance with our Privacy Policy and
the Privacy Act 2020.
When you contact us by WhatsApp, your message is also handled by the
provider of that service under its own terms.
9. AVAILABILITY OF THIS WEBSITE
We do our best to keep this website available and accurate, but we do not
promise it will be uninterrupted, error-free, or free of viruses. We may
change, suspend or withdraw any part of it at any time.
10. LIABILITY
Nothing in these terms limits or excludes:
- your rights under the Consumer Guarantees Act 1993, where you deal
with us as a consumer;
- your rights under the Fair Trading Act 1986;
- liability for death or personal injury caused by our negligence, or
for fraud.
Subject to that, and to the extent the law allows, we are not liable for
indirect or consequential loss, loss of profit, loss of opportunity, or
loss arising from your reliance on general information published on this
website.
If you acquire goods or services from us for the purposes of a business,
the Consumer Guarantees Act does not apply, and you agree that sections
9, 12A and 13 of the Fair Trading Act do not apply, in each case to the
extent permitted by law. Where that is the case we will record it in
writing at the time of sale.
11. CHANGES TO THESE TERMS
We may update these terms from time to time. The version published on
this page at the time you use the website is the version that applies.
The "last updated" date above tells you when we last changed them.
12. LAW AND DISPUTES
These terms are governed by New Zealand law, and the New Zealand courts
have jurisdiction.
If you have a problem, please contact us first. Most things are sorted
out with a phone call. If we cannot resolve a dispute about a vehicle you
bought from us, you may be able to apply to the Motor Vehicle Disputes
Tribunal, and you can get free advice from Consumer Protection at
consumerprotection.govt.nz.
